The term "Websito" or 'us' or 'we' or 'the company' or 'website' or 'site' refers to the owner of the website whose registered office is at Noida. The term 'you' refers to the 'user'or 'Client' or 'Affiliate Partner' or 'Registered user' or ' Demo Subscriber' or 'Blogger'. Agreement Terms, Conditions and Policies are:

Terms of Use:

User/s: any person who browse and uses website includes but not limited to Clients, Affiliate Partners, Employee, Bloggers.

Client/s: any user who subscribe/taken right to use or buy any services/products from WebSito.

Affiliate Partner/s: a commission agent, channel sales partners, branch office partners, an employee to whom Referral code issued.

Registered User/s: Any person who has taken online registration or sends an online request for Demo, Affiliate Partnership, to buy services/products, posting any article on site includes but not limited to Users, Clients and Affiliate Partners.

Blogger/s: Any person who uses our site for posting or listing any article,comments or for any other purposes.

Referral Code: a system generated random code issued to every affiliate partners, clients, bloggers, employees for encouraging and boosting sales

Working Hours: 10 AM to 6 PM on Indian Standard time from Monday to Friday except on Gazetted and public holidays in India.

A) Applicability: The terms shall apply to all registered users or un registered users w.e.f from 19th June 2017 and shall give retrospective effect, if there is any changes to the terms in future. You must have acceptance to continue our services.

This Agreement applies to you, whether you are –

1. A Chartered Accountant, Cost Accountant, Company Secretary, Lawyer or Firm/LLP/Company thereof

2. Any other user who browse, use and views.

3. Other User, intend to use or uses our site for posting, listing, comments or for any other purposes.

Use of www.WebSito.in, either by registration or by any other means, is available only to persons, who are Citizens of India and who are 18 years of age and above and the persons who can enter into a legally binding contract (Under Indian Contract Act) , and or are not barred by any law for the time being in force. If you access 'Websito', either by registration on the Site or by any other means, not as an individual but on behalf of a legal entity, you represent that you are fully authorized to do so and subscribe plan, make online payment, the listing, posting or information placed on the site on behalf of the legal entity is your responsibility and you agree to be accountable for the same to other users of the Site.

B) Personal Information & Privacy Policy: -

"Personal information" is defined to include information that whether on its own or in combination with other information may be used to readily identify or contact you such as: name, address, email address, phone number etc., collected during your account registration process, survey conducted by the company or its group concerns or by third parties, social media (Facebook, twitter etc) through which you created your account, your service listing, posting, feedback, comments, review or discussions you post in any blogs, chat room or from any other sources which directly or indirectly relates to or concerns with matters and/or services of Websito.

This privacy policy describes how we handle your personal information. We collect, use, and share personal information to help Websito Website and Mobile Application work and to keep it safe (details below). In simple words, we, acting itself and through its subsidiaries or group concerns, is the "data controller" of your personal information.

We use users' personal information –

1. Information we collect is safely keeps in our custody and do not disclose or share it to/with third parties or external organization except our group concerns, Affiliate Partners or Channel Partners.

2. We value users privacy and important for us. We do not and shall not at any point in time, either sell or rent users' personal information to third parties or external organizations without users' explicit consent.

3. We may be required from time to time to disclose users' personal information to Governmental or law enforcing agencies or our regulators, but we will only do so under proper authority.

4. We also reserves the right to make use of the personal information in any investigation or judicial process relating to fraud on account of such transactions during the period Websito retains such information.

5. We may also disclose personal information to enforce our policies, respond to claims that a posting or other content violates other's rights, or protects anyone's rights, property or safety.

6. We may also share your information with your legal consultants and service providers.

7. As we participate in third party ad networks that may display advertisements on other websites based on your visits to our Site as well as other websites and applications. This enables us and these third parties to target advertisements by displaying ads for products and services in which you might be interested. We, produces information about all information posted by any registered members, content partners, service providers, employees or any other person who is using this site. We always makes every effort to ascertain the authenticity of the contents, information, materials and services on the site.

Further, the accuracy of such content, integrity or quality of such content and the information on Websito pages, or on the clients websites (we develop) may include technical inaccuracies or typographical errors, and we do not take any liability or warrantee or guarantees, nor can be responsible for any such information, including its authenticity, currency, content, quality, copyright compliance or legality, or any other intellectual property rights compliance, or any resulting loss or damage. Further, We are not liable for any kind of damages, losses or action arising directly or indirectly due to any content and information, including any errors or omissions in any content, access and/or use of the content on the site or any of them including but not limited to content based decisions resulting in loss of data, revenue, profits, property, infection by viruses etc.

It is your responsibility to investigate by yourself before you rely on the contents, information, & services made available on the site or get full information on call or email from our Client Relation Desk.

D) Service Terms, Guarantee and Cost for Clients:

The Company provides service of web designing and development for professionals includes Chartered Accountants, Cost Accountants, Company Secretary, Lawyers. We provide self manage inbuilt templates to clients with basic features and option to customize it.

a) The company provides sales and services of Pre-Build Websites, Design and Development of Websites and Mobile Application, Web hosting and any other on demand supplementary services relates to the above specified sales and services.

b) We deliver right to use pre build templates with basic common contents, images, and structure within 2 working hours from the date and time of payment success or credited into our bank account. Preparing particular contents and all other materials is client's responsibility. However we have on demand special services to assist our clients till their website get ready to use with their specific contents.

c) Service Period :Clients should maintain and retain services with us for minimum period of 3 years. On expiry of minimum period,clients shall be free to transfer his domain without any charges.

d) Annual Maintenance: Clients have agreed to maintain their hosting for minimum 3 years with us on payment of prescribed annual maintenance charges. Annual Maintenance Charges covers, a) Domain Renewal charges, b) Hosting charges/ Server rental, c) service charges and d) applicable taxes. Amount of Annual Maintenance charges mentioned on website.

e) The company also provides on demand services on special request, includes customization of design and development of websites, contents writing, Gmail Server, Outlook Setup, Google Map address registration, SEO & Digital Marketing, Chat Integration, Domain Security (https, SSL certification), Payment gateway integration, Mobile Application Development etc. on payment of extra charges as mention on website www.WebSito.in or communicated to clients separately.

f) Clients have the right to choose his own design theme and can opt to switch to different design anytime online using admin panel free of cost.

g) All rates may change anytime with or without prior notice to existing clients. Clients must get updated information from www.websito.in.

h) Mode of Payment: We accept payment for the sales and services 'online' through our payment gateway partner or in some cases we also accept payment by Cheque/DD/NEFT/RTGS. In case of Payment made by DD/Cheque – Bank charges due to non-clearance or bounce shall be recoverable from payer.

i) Cancellation Policy : We do not have the option to cancel any order once we accept payment in our bank account unless we are unable to deliver our website within 15 days.

j) Source code and Website design, articles shall be the property of the company and clients shall have no right to claim as proprietor.

k) Clients well understand that he/she is 'taking the right to use services (web templates with other features attached thereto) for a year subject to extendable with renewal on payment of annual maintenance charges.

l) Technical Issues: We host our database with third party hosting service provider "Godaddy". We have no direct control over the 'Godaddy' and Sometimes due to technical issues, service down , server crash, or for any unavoidable reason, cyber malware attack, Hacking,natural calamity or Act of God, our services may be interrupted towards clients or there is possibility of loss of database. Clients agreed not to take compensation from us or lodge any claim for the damage on us. Our Agreement with Godaddy shall also bind our clients to agree on all clauses. If Clients are not agreed on terms, shall advise not to take our services.

m) Every Client shall get a Referral Code and encourage referring 10 people. On success sale of 10 website through your referral, one year Annual maintenance free. Also Read with clause (H).

E) Demo Subscriber's terms and policies:

a) We provide Demo website, admin panel with few design templates on dashboard to online Demo Subscribers with all features to Update, edit, delete and add new contents, banners, images etc. free of any charges.

b) Demo shall valid till 6 hours from the date and time of subscription taken.

c) Mode of Demo Subscription is online. User ID & Password send on Registered Email ID/Mobile number.

d) In no case shall Demo Subscriber copy any theme, images, and contents for his/her personal or commercial use.

e) You can not subscribe demo more than once with your same particulars or any mode.

f) You also authorize our sales & Marketing Department, Affiliate Partners to Contact you.

g) In addition to the above clauses, all other terms and conditions and policies of the company shall also apply to Demo Subscriber.

F) Affiliate Partner's terms and policies:

a) Users intended to join as affiliate partner shall apply online on www.websito.in/affiliate with correct required details.

b) Affiliate Partner shall receive message of acceptance within 24 working hours on registered Email ID/Mobile number with login credential and referral code. If not received, you may assume it is rejected or you can send an email or call to our customer care team to know the exact status.

c) We shall allot an unique Referral Code to all affiliate Partners and/or their employees, selling partners, Sub-affiliate partners and send to their registered Email ID/Mobile number.

d) Non-refundable onetime Joining fee for Affiliate partners is Rs. 25,000/-. Which Company at its sole discretion may exempt in some cases.

e) Affiliate Partners shall have to use WebSito Banner, Signboard, visiting card , logo and all other materials for their marketing and selling purposes.

f) Affiliate Partner agreed not to damage the goodwill of the company any manner.

g) Affiliate Partners shall receive a fixed commission range Rs 500 - Rs 750 on selling website and bonus/incentive range 5-10% on other services/products sale.

h) Company shall at its discretion and/or based other factors decides the exact rates of Commission/Incentive/Bonus and communicated to Affiliate Partner on registered Email ID.

i) Payment Terms – Company remit payment to Affiliate Partners on monthly basis by 7th of the following month. TDS or any statutory liability if apply shall be deductible before remittance.

j) Affiliate Partner have right to sublet their affiliation ( herein called as Sub-Affiliate Partner). Payment to Sub-Affiliate Partners shall be made by Affiliate Partners from their own share of Commission/Bonus/Incentive and Company shall not be not liable for any expenses of Sub-Affiliate Partner.

k) Affiliate and Sub-Affiliate Partners shall provide ID and Address Proof, PAN Card, GST registration number and copy within 15 days of their application got acceptance.

l) In some cases, if sales done on manual and Affiliate Partner collect payment through cheque/DD/NEFT, then he has to make deposit to the company's bank account within 12 working hours and send a communication message to the company, failure of which shall be treated as no sales done.

m) Online sales specific rule - Affiliate and Sub-Affiliate Partner's sale Shall be counted and recorded online based on referral code uses by clients while making payment online. It is advisable to guide and instruct your clients for usage of the Referral code and its benefit. If the clients do not use referral code, it will not be possible to track your transactions and consequently you need to lose your sales commission/incentive/bonus.

n) Benefit of Referral code - Every Referral code carrying a guarantee discount of Rs 100-500. For details refer clause (H).

o) Company shall have sole right to cancel Affiliation if found violation of any terms and conditions.

p) In addition to the above clauses, all the terms & conditions and policies of the company shall also apply to Affiliate partners and Sub-Affiliate Partners.

G) Bloggers Terms and Policies:

a) Users intended to join as Bloggers shall apply online on www.websito.in/blogger with correct required details.

b) Blogger shall receive message of acceptance within 24 working hours on registered Email ID/Mobile number with login credential and referral code. If not received, you may assume it is rejected or you can send an email or call to our customer care team to know the exact status.

c) Blogger submit their article to WebSito for review and screening. Once approved, Article circulates to all websites powered and run by WebSito as well to channel partner's website and Mobile app.

d) Article should relates to Economy, Finance, Accounting, Business Management, Legal, Corporate Affair and Taxation and should not be copied from any other website.

e) Company shall not be liable for any copyright or other legal disputes if arises on account of any article posted by blogger. Blogger shall be responsible and take care that no contents or article , images, copied from any other website or do not create any falsification statement on statement published by government, any authority, news agencies.

f) With Referral code, Bloggers can also act as sales partners under affiliation scheme of the company. Rules and regulations apply for Affiliate Partners shall also apply to Bloggers as well.

g) In addition to the above clauses, all the terms & conditions and policies of the company shall also apply to Bloggers.

H) Referral Discount Scheme:

a) Company introduces the Scheme 'Referral Discount' for its clients and affiliate partners benefit.

b) Every Referral code carrying a guarantee discount of Rs 100-500 with minimum bill value Rs 4,999/-.

c) Referral Discount valid for online Transactions on www.WebSito.in .

I) Before you use our website and services, you should read this agreement. If you do not agree with terms & conditions and Policies of websito, we advise you do not use our website and services.

J) Exclusive right to Amend clauses: we shall have exclusive right to delete, add, modify any clauses of the agreement and shall apply on you with retrospective effect. We do not send or inform amended copy individually. You need to check time to time on our website.

K) All disputes shall be under jurisdiction of Noida, Gautam Buddha Nager, Uttar Pradesh, India.
